California Divorce Overview

In California, one party initiates the dissolution proceeding by filing a Petition. The respondent will then be served the Petition (either personally or by mail). The party originally filing the Petition is known as the “Petitioner” and the other party is known as the “Respondent”. Following receipt of the Petition, the Respondent has 30 days (unless granted additional time by the Petitioner’s attorney) in which to file his or his responding statement. After the 30-day period the case can be set for a Court hearing. The process is complex and takes a while. Uncontested Divorce

The term “uncontested divorce” can mean two paths (1) where both spouses agree on all issues concerning the divorce, including but not limited to the division of marital assets, property and debts, child custody, child support, and spousal support (alimony), or (2) where one spouse is taking a deliberately passive role and refuses to or does not engage in the process. Spousal Support

(1) – Temporary spousal support – is the support that will be paid to the supported spouse from the time of separation to when the divorce process is concluded, whether by a negotiated final settlement agreement or a trial. (2) – Permanent spousal support is not really permanent — as in life-long — but it is the amount of spousal support that is agreed to or ordered by the court at the conclusion of the divorce process.

Legal custody of a child is the right and obligation to make decisions about a child’s upbringing. Decisions about schooling and medical care, for example, are made by the parent with legal custody. In California, it is presumed and common for an award of joint legal custody, which means that the decision making is shared by both parents.
